29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on February 9, 2019, when employees of King Construction USA, Inc. are working on the roof of a three story 7:12 pitch, residence without fall protection and are exposed to falls of approximately 20 feet to the ground below.  King Construction USA, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11) which was contained in OSHA inspection number 1206582, citation number 1, item number 1 and was affirmed as a final order on April 17, 2017, with respect to a workplace located at 442 Blanding Blvd, Orange Park, FL 32065. The employer was assessed a penalty of $10,140.00.  King Construction USA, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1205851, citation number 1, item number 1 and was affirmed as a final order on April 17, 2017, with respect to a workplace located at 541 John Anderson Drive, Ormond Beach, FL 32176. The employer was assessed a penalty of $23,901.00.
