29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On May 23, 2019 Decal Construction did not implement the engineering controls specified for the task on table 1 of the respirable crystalline silica standard. As a result, employees were exposed to contact with a toxic substance by inhalation through respiratory tract. An employee was observed using a handheld power saw to cut face bricks containing crystalline silica. The handheld power saw was not equipped with an integrated water delivery system that continuously feeds water to the blade.

This was most recently documented on or about May 23, 2019 when Decal Construction failed to conduct an assessment for potential exposure to respirable crystalline silica while employees were cutting face brick that contained crystalline silica.
