29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Worksite was located at Building 59; 5901-5906 Tudor Drive, Pompton Plains, NJ 07444  Employees performing re-roofing work on Building 59 of The Glens were exposed to fall hazards as they were working on an 8 and 10 slope roof that was over two stories tall with no fall protection.   Violation was observed on July 2, 2019.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) Worksite was located at Building 60; 6001-6006 Tudor Drive, Pompton Plains, NJ 07444  Employees performing re-roofing work on Building 60 of The Glens were exposed to fall hazards as they were working with a six foot tall Werner a-frame step ladder that was used in its folded position to access and egress the upper roof elevation.  Violation was observed on July 5, 2019.

29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, were not withdrawn from service until repaired:  a) Worksite was located at Building 60; 6001-6006 Tudor Drive, Pompton Plains, NJ 07444  Employees performing re-roofing work on Building 60 of The Glens were exposed to fall hazards as they were using a 24 foot Werner extension ladder with a bent frame to access and egress the lower roof elevation of the building they were working on.  Violation was observed on July 5, 2019.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Worksite was located at Building 59; 5901-5906 Tudor Drive, Pompton Plains, NJ 07444  Employees performing re-roofing work on Building 59 of The Glens were exposed to fall hazards as they were working on an 7/12 roof pitch that was approximately twenty six feet high from the ground with no fall protection.   Violation was observed on July 2, 2019.  b) Worksite was located at Building 60; 6001-6006 Tudor Drive, Pompton Plains, NJ 07444  An employee performing re-roofing work on Building 60 of The Glens was exposed to fall hazards as he was working on a 10 slope roof that was approximately twenty three feet tall with no fall protection.   Violation was observed on July 5, 2019.  JA General Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1331869, citation number 1, item number 1, and was affirmed as a final order on 03/12/2019, with respect to a workplace located at Building 48, Nast Road Morristown, NJ; and also in inspection number 1290478, citation number 1, item number 1, and was affirmed as a final order on 06/13/2018, with respect to a workplace located at 113 Columbia Road, Building #44, at the Residences @ Columbia Park, Morristown, NJ.
