29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On July 13, 2019, Located throughout a commercial structure, employees were exposed to a fall hazard while performing roofing work as there were no frequent and regular inspections being performed by a competent person to ensure the job-site, materials and equipment such as fall protection systems and/or devices were being maintained and utilized in a safe condition. Potential fall height measured to be 22' with a roof pitch of 8/12. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On July 13, 2019, located throughout a commercial structure, the employer failed to provide and install a fall protection system prior to employees installing roofing shingles onto a steep pitch roof. Potential fall height was measured to be 22 with a roof pitch of 8/12.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. The employer does not protect employees from falls by providing necessary fall protection. The most recent incident of such failure occurred on July 13, 2019 as employees were observed installing shingles throughout a commercial steep pitched roof while not utilizing an adequate fall protection system. Potential fall heights measured to be 22' with a roof pitch of 8/12.
