29 CFR 1926.602(c)(1)(viii): A lift truck, equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, did not have the following additional precautions for the protection of the personnel being elevated (A) Use of a safety platform firmly secured to the lifting carriage and/or forks (B) Means whereby personnel on the platform can shut off power to the truck (C) Protection from falling objects as indicated necessary by the operating conditions.  a) Employee(s) rode inside the cartage box secured to the forks of a JLG articulated-boom all-terrain forklift during material handling in the parking lot as well as for access to/from the roof of Building 101 in Beverly Hills Terrace Apartments in Woodbridge NJ, where elevatable controls with means to shut off power to the truck was not available on the personnel platform; exposing employee(s) to fall hazard of more than 25 ft.  Condition(s) were noted on or about 7/25/2019.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Employee(s) replacing skylights atop the roofs of 101 Woodbridge Terrace and 93 Beverly Hill Terrace within Beverly Hill Terrace condominium complex in Woodbridge NJ were not protected from falls of 28 and 20 ft. through use of personal fall arrest equipment or other means of fall protection.  Condition(s) were noted on or about 7/25/2019.  Lemus Construction, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1266804, citation number 1, item number 2 and was affirmed as a final order on 10/20/2017, with respect to a workplace located at Building 21, Oxford Road in Blue Bell, PA 19422.
