29 CFR 1910.134(a)(2): On or about September 14, 2020, the employer did not provide appropriate respirators when necessary to protect employee health: 	                                                      a)	Noah's Ark Processer's, LLC located at 1009 W M St., Hastings, Nebraska 68901:  Employees engaging in employee temperature screenings were not consistently provided with and required to use N95 respirators for protection against aerosolized SARS-CoV-2 virus or were provided only with surgical mask or other deficient protective device for protection against aerosolized SARS-CoV-2 virus.   The violation occurred on or about September 14, 2020 and after.

29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): 	                                                      a)	Noah's Ark Processer's, LLC located at 1009 W M St., Hastings, Nebraska 68901:  On or about September 14, 2020, the employer had not written and certified an assessment to determine if hazards such as SARS-CoV-2, the virus that causes COVID-19, were present and necessitated the use of PPE in order to protect employees who had contact with suspected or confirmed COVID-19 employees.   The employer failed to ensure that a workplace evaluation was written and certified to verify what personal protective equipment was needed for employees.
