29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. (a) Westward Seafood's Dock - FV Nordic Fury - On or about April 1, 2021, employees were exposed to failure of the Rapp Marine Crane's lifting and rigging equipment in that there was no anti two-blocking device or equivalent alternative. Anti two-blocking devices or equivalent alternatives are designed to prevent the hoist line from coming into contact with the boom tip, or similar, which can cause failure of the hoist rope or other components.

Gangways meeting the requirements of paragraphs (a)(1), (2), (9), (10), (11) of this section were not provided for access from wingwall to vessel or, when two or more vessels, other than barges or river towboats, are lying abreast, from one vessel to another. (a) Westward Seafood's Dock - FV Nordic Fury - On or about April 1, 2021, employees were exposed to falling into the water when transiting between FV Nordic Fury, FV Pacific Prince, and the pier without a gangway, brow or other safe means of access and egress.
