OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards from exploding plastic (polyvinyl Chloride (PVC) pipe: On or about April 19, 2022, in the tire shop area, employees were exposed to struck-by hazards from explosion and sharp shards flying in the air from the use of plastic polyvinyl chloride (PVC) piping used to transport above ground compressed air to the Corghi A9824 Swing Arm Tire Changer.

29 CFR 1910.177(d)(2): The employer did not provide a restraining device or a barrier to be used when inflating tires on single piece rim wheels which are not bolted onto the tires. On or about April 19, 2022, at the Tire shop, employees were exposed to struck-by hazards while inflating twenty-two to twenty-four inch tires without a restraining device.
