29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Throughout the facility: On or about August 2, 2023, the employer exposed employees to chemical hazards, in that a written hazard communication program was not available for employee use. Chemicals used at the restaurant include but are not limited to, carbon dioxide, Germicidal bleach, Kleen Pine #5, Concentrated Industrial Purple Degreaser, CleanForce Enzyme Presoak, Rapid Multi Surface Disinfectant Cleaner and Heavy-Duty Degreaser.

29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) Housekeeping area:  On or about August 2, 2023, the employer exposed employees to burn hazards, in that an eyewash was not available for employees using corrosive chemicals, such as, but not limited to, Germicidal Bleach, and Heavy-Duty Degreaser.  The Moapa Paiute Travel Plaza was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1559126, citation number 01, item number 01 and was affirmed as a final order on November 24, 2021, with respect to a workplace located at Interstate 15 N, Exit 75, Moapa, Nevada.

29 CFR 1910.101 (b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  a) Back storage room: On or about August 2, 2023, the employer exposed employees to struck by hazards, in that carbon dioxide tanks were not secured. If the tanks were hit/fell down accidentally the cylinder(s) could become a become a projectile striking anything in its path.
