29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  At the jobsite, employees operating a Metabo nail gun to perform roofing activities without eye and face protection exposing him to the hazard of being struck-by flying objects.  Jesus Vega Acosta was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1529549, Citation Number 1, Item number 1, and was affirmed as a final order on June 9, 2021, with a final abatement date on May 7, 2021,  with respect to a workplace located at 2316 Elm Place, Northlake, TX 76247.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system.  At the jobsite, employees installing roofing material to a new residential house were not provided fall protection and exposed to an unprotected fall hazard at a height of over 6 feet to the ground below.  Jesus Vega Acosta was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1529549, Citation Number 1, Item number 2, and was affirmed as a final order on June 9, 2021, with a final abatement date on May 7, 2021,  with respect to a workplace located at 2316 Elm Place, Northlake, TX 76247.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  At the jobsite, employees performing roofing activities without fall protection were not provide a training program with hazard recognition and avoidance training where part of the job is to be exposed to fall hazards at a heights over 6 feet to the ground below.

29 CFR  1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:     Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) When the employer has reason to believe that any affected employee does not  have the understanding and skill required;   At the jobsite, where employees performing roofing activities were exposed to fall hazards up to approximately 20 feet, did not receive retraining on hazard recognition and avoidance to fall hazards at heights over 6 feet to the ground below.
