29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  At the jobsite, employees operating a Metabo nail gun to perform roofing activities without eye and face protection exposing him to the hazard of being struck-by flying objects.  Jesus Vega Acosta was previously cited for repeat violation of this occupational safety and health standard or its equivalent standard 1926.102 (a)(1). which was contained in OSHA inspection number 1736834, Citation number 2, Item number 1, and was affirmed as a final order on April 19, 2024, with a final abatement date on   April 2, 2024, with respect to a workplace located at 1213 Fieldstone Drive, Midlothian, TX 76065.  Jesus Vega Acosta was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1697657, Citation Number 1, Item number 1, and was affirmed as a final order on October 16, 2023, with a final abatement date on October 6, 2023,  with respect to a workplace located at 1849 Rough Ridge Drive, Midlothian, TX 76065. 29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system.  At the jobsite, employees removing old shingles and installing new underlayment to the roof of the house, were not wearing fall protection, exposing the employees to an unprotected fall hazard at a height of over 6 feet to the ground below.  Jesus Vega Acosta was previously cited for repeat violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13). which was contained in OSHA inspection number 1736834, Citation number 2, Item number 2, and was affirmed as a final order on April 19, 2024, with a final abatement date on   April 2, 2024, with respect to a workplace located at 1213 Fieldstone Drive, Midlothian, TX 76065. 29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   At the jobsite, where employees performing roofing activities were exposed to fall hazards up to approximately 18 feet and did not demonstrate hazard recognition and avoidance to fall hazards at heights over 6 feet to the ground below.
