29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 108 Sofia Drive, Manalapan NJ: The employer did not ensure that each worker who utilized Pettibone All-Terrain lifts at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 10/04/23. On or about 10/04/23 the company worksite Foreman was operating two Pettibone All-Terrain lifts to deliver sheathing materials and a metal garbage box to the worksite workers.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.   a) 108 Sofia Drive, Manalapan NJ: On or about 10/04/24, a Pettibone All-Terrain lift, used to deliver and support a stack of OSB to workers working from the pitched roof trusses of a worksite residential structure, was left unattended with the load engaging means raised and extended, the key left in the ignition, and the brake not set thereby exposing workers to the hazard of being struck by the vehicle or its supported load.  b) 108 Sofia Drive, Manalapan NJ: On or about 10/04/24, a Pettibone All-Terrain lift, used to deliver and support a steel box used to remove debris generated by those workers who were performing sheathing installation and other framing related activities at the worksite, was left unattended with the load engaging means raised and extended, the key left in the ignition, and the brake not set thereby exposing workers to the hazard of being struck by the vehicle or its supported load.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a- 108 Sofia Drive, Manalapan NJ:  Workers and the company Foreman were exposed to struck by hazards when using air nailers and portable circular saws without eye or face protection.  Condition observed on or about 10/04/23.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a- 108 Sofia Drive, Manalapan NJ: On or about 10/04/23 a worker was exposed to fall hazards, in excess of  14 feet to the ground surface below, when working from/standing on a stack of OSB sheets while they rested, unsecured on the elevated forks of an all terrain fork truck. This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   a- 108 Sofia Drive, Manalapan NJ: On or about 10/04/23 a worker was exposed to fall hazards, in excess of  14 feet to the ground surface below, when standing on a pile of OSB sheets that were set, unsecured, on the elevated forks of an all terrain fork truck.   These OSB sheets were not attached to the forks of this fork truck.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

This was not utilizing any fall protection at the time of the exposure. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 108 Sofia Drive, Manalapan NJ:  The company worksite Foreman and their workers were exposed to fall hazards, in excess of 19 feet to the ground surface below when applying sheets of OSB to a residential structure's upper,  without the use of fall protection.  Condition observed on or about 10/04/23  b- 108 Solfia Drive, Manalapan NJ:  A worker was exposed to fall hazards in excess of 14 feet to the cement flooring below when walking and working from a residential structure's pitched dormer roof  while wearing a full body harness that was not connected to an anchor with a lanyard or other approved means.  Condition observed on or about 10/04/23.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
