29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) 70 Magnolia Drive, Freehold NJ:  On or about 11/16/23 the employer did not develop and implement a hazard communication program to include all the provisions in 29 CFR 1910.1200(e)(1).  A worker was exposed to silica when using a Stihl TS 420 power saw to cut concrete and Belgium Block. The concrete and Belgium Block contained crystalline silica. The concrete mixture contained approximately 47% Silicon Dioxide (crystalline silica).    IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1153(i)(1): The employer did not ensure that each employee is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section:  The employer did not ensure that at least the following hazards were addressed: Cancer, lung effects, immune system effects, and kidney effects.    a) 70 Magnolia Drive, Freehold NJ:  The company did not train a worker and the company worksite Foreman on the hazards of silica.  On or about 11/16/23  a worker was observed dry cutting concrete and Belgium Block with a Stihl TS 420 power saw. The concrete and Belgium Block contained crystalline silica.  The concrete mixture contained approximately 47% Silicon Dioxide (crystalline silica).    IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Observed on or about 11/16/2023.  b) 70 Magnolia Drive, Freehold NJ:  A company worker was exposed to eye and face injuries when cutting Belgium block curbing with a gasoline powered Stihl TS 420 without the use of eye/face protection. Observed on or about 11/16/2023.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- Front & Back of Residential Structure - 70 Magnolia Drive, Freehold NJ: On or about 11/16/23 workers were not protected from falling when performing roofing and other related work from a residential structure's pitched roofs while wearing full body harnesses that were not connected to anchors with lanyards or other approved means .  As such, these workers were exposed to fall hazards up to and in excess of 11 feet 8 inches to the ground surface below.  b - Back of Residential Structure -70 Magnolia Drive, Freehold NJ: On or about 11/16/23 a worker was not protect from falling when performing roofing and other related work from a residential structure's pitched roof while improperly connected to an anchor by a lanyard whose one end was connected to the anchor and the other connected to the side strap of the full body harness they were wearing .   As such, this worker was exposed to fall hazards up to and in excess of 12 feet 2 inches feet to the ground surface below.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a- 70 Magnolia Drive, Freehold NJ:  The company worksite Foreman was exposed to fall hazards, in excess of 11 feet 8 inches to ground surface below, when accessing and egressing a residential structure's pitched roof from a aluminum extension ladder whose side rails did not extend at least three feet above the surface being accessed. Condition noted on or about 11/16/23.  Road Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1686108, citation number 1, item number 4 and was affirmed as a final order on 10/02/23, with respect to a workplace located at 116 Main Street - Bethesda United Methodist Church, Middletown DE.
