29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 1001 Tuckerton Road, Evesham NJ: The employer did not ensure that each worker who utilized a Baraga Products, Inc., Square Shooter, Terex All Terrain Lift at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 02/06/24. On or about 02/06/24 the company worksite Foreman was operating a Baraga Products, Inc., Square Shooter, Terex All Terrain Lift to deliver framing materials to the worksite workers.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   a) 1001 Tuckerton Road, Evesham NJ:   The employer did not ensure that the company worksite Foreman, operating a powered industrial truck used at the worksite, complied with all applicable requirements as defined in the ANSI B56.1-1969, including but not limited to lowering any load, removing the keys from the machine's ignition, etc. prior to exiting the powered industrial truck.   The company worksite Foreman, operating a Baraga Products, Inc. Square Shooter Terex All Terrain Lift, elevated unsecured 2 x 4s set on the lift's forks, in excess of 12 feet above the ground, and left this lift unattended with its forks elevated, partially tilted back, and not landed onto a residential structure's second floor to perform framing and sheathing activities.  ANSI B56.1 - 1969, Safety Standards for Powered Industrial Trucks, requires that when leaving a Powered Industrial Truck unattended, load engaging means shall be fully lowered, controls shall be neutralized, the key or connector plug removed, etc. Observed on or about 02/06/24.

Condition observed on or about 02/06/24.  b - 1001 Tuckerton Road, Evesham NJ:  Workers  and the company worksite Foreman were exposed to fall hazards, in excess of 10 feet 2 inches to the flooring below, when walking and working near and at the unprotected edges of a residential structure's second floors floor opening while not using fall protection.  Condition observed on or about 02/06/24.  Road Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1707205, citation number 2, item number 1 and was affirmed as a final order on 12/27/23, with respect to a workplace located at 99 Wall Street, Passaic, NJ 07055 .  Road Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1703189, citation number 1, item number 1 and was affirmed as a final order on 2/1/24, with respect to a workplace located at 10 East 20th Street, Long Beach Township, NJ 08008.
