29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   a) 37 Vinegold Drive, Mullica Hill NJ:  The employer did not ensure that the company worksite Foreman operating a powered industrial truck used at the worksite complied with all applicable requirements as defined in the ANSI B56.1-1969, including but not limited to lowering any load, removing the keys from the machine ignition, etc. prior to exiting the powered industrial truck.   The company worksite Foreman, operating a JLG All Terrain Lift, elevated unsecured 4 x 8 sheets of OSB set on the lift's forks, in excess of 13 feet above the ground, and partially set the lift's elevated forks onto a residential structure's pitched roof and then exited the lift to perform sheathing and other related activites.  ANSI B56.1 - 1969, Safety Standards for Powered Industrial Trucks, requires that when leaving a Powered Industrial Truck unattended, load engaging means shall be fully lowered, controls shall be neutralized, the key or connector plug removed, etc. Observed on or about 03/08/24.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a- 37 Vinegold Drive, Mullica Hill NJ:  The company worksite Foreman and a worker were exposed to struck by hazards when using pneumatic nailers without eye or face protection while performing framing, sheathing, and other related activities at the worksite. Condition observed on or about 03/08/24.  Road Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1683054, citation number 1, item number 1 and was affirmed as a final order on 01/19/24, with respect to a workplace located at 100 Executive Drive, West Orange NJ.  Road Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1707205, citation number 1, item number 1 and was affirmed as a final order on 12/27/23, with respect to a workplace located at 99 Wall Street, Passaic NJ.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a-37 Vinegold Drive, Mullica Hill NJ: On or about 03/08/24 the company worksite Foreman was exposed to fall hazards in excess of 10 feet 1 inch to the ground below, when performing sheathing installation and other related activates from a residential structure's pitched roof without the use of fall protection.  b - 37 Vinegold Drive, Mullica Hill NJ: On or about 03/08/24 a worker was exposed to fall hazards in excess of 23 feet 9 inches to the ground surface below, when performing framing and other related activities while at unprotected edges of a residential structure's endframe and while standing on wood set within the upper, interior wooden chords within roof trusses while not using fall protection.  Road Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1707205, citation number 2, item number 1 and was affirmed as a final order on 12/27/23, with respect to a workplace located at 99 Wall Street, Passaic, NJ 07055 .  Road Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1703189, citation number 1, item number 1 and was affirmed as a final order on 2/1/24, with respect to a workplace located at 10 East 20th Street, Long Beach Township, NJ 08008.
