29 CFR 1910.28(b)(1)(i)(C): Protection from fall hazards. Unprotected sides and edges. Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. On or about August 8, 2024, at 8133 US 10 Hwy in White Law, Wisconsin, fuel loading rack station, an employee was exposed to a fall hazard working from the top of a 4500-gallon tank truck 9.5 feet above concrete surface without using required fall protection equipment. No fall protection equipment was provided for unprotected edges on 13 top loading tank trucks.

29 CFR 1910.30(a)(1): Walking-Working Surfaces. Training requirements. Fall hazards. Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On or about August 8, 2024, at 8133 US 10 Hwy in White Law, Wisconsin, fuel loading rack station, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than four feet while working from the top of fuel tank trucks.
