29 CFR 1910.178(q)(1):Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. On or about August 22, 2024 the employer did not ensure that the Clark Walk Behind, Model #WSTX33, Serial #WSTX33-0028-8286CH walk behind forklift was removed from service and repaired before returning it to service. The employer did not ensure that the operating handle for the forklift was intact and that the cover around the battery was repaired.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a.) On or before August 22, 2024, the employer did not ensure that the XN half ton Hoist located in the was removed from service in that a safety latch on the hook of the XN half ton -underhung hoist was broken. Employees were exposed to crush injuries in that the load could become de-attached from the hook as employees used the hoist to lift 500 pound steel rotary lids in the Cotton Room. Cheney Dynos was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH Act of 1970 Section 5(a)(1), which was contained in OSHA inspection number1682064, citation number 1 , item number 1, and was affirmed as a final order on 11-16-2023, with respect to a workplace located at 1000 Anderson Street FRANKLIN, OH 45005.
