1910.23(b): General requirements for all ladders. The employer must ensure:  (9) Ladders are inspected before initial use in each work shift, and more frequently as necessary, to identify any visible defects that could cause employee injury;  (10) Any ladder with structural or other defects is immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with §1910.145 and removed from service until repaired in accordance with §1910.22(d), or replaced;  a) On or about 08/22/2024, the employer did not ensure that the Werner 12 foot ladder used to access the fan located above the maintenance shop was free of defects such as: the bent side rail at the 3rd and 4th rung nor was the ladder tagged and removed from service.

29 CFR  1910.23(c)(11): Portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface (see Figure D-1);  a) On or before 08/22/2024, the employer did not ensure that the 12 foot Werner ladder being used in the loft of the maintenance shop was extended 3 feet above the edge of the opening that employees were using to access the platform to reach the exhaust fan located on the loft landing.

29 CFR  1910.30(a)(3): The employer must train each employee in at least the following topics:  (i) The nature of the fall hazards in the work area and how to recognize them; (ii)The procedures to be followed to minimize those hazards;  a) On or about 08/22/2024, the employer did not ensure that employees were adequately trained to ensure the 12 foot Werner ladder being used in the loft of the maintenance shop was extended 3 feet above the edge of the opening that employees were using to access the exhaust fan located on the loft landing, nor to inspect for damage on the 12 foot Werner ladder side rails that was bent.  b) On or about 09/07/2024, the employer did not ensure that employees were adequately trained on the procedures for when to wear fall protection while moving conveyor heads over holes that pour material in the rotaries.  Dynos Group GMBH was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.30(a)(3), which was contained in OSHA inspection number 1682064, citation number 1, item number 3, group letter c, and was affirmed as a final order on 11/16/2023, with respect to a workplace located at 1000 Anderson Street, Franklin, OH 45005.

29 CFR  1910.145(a)(1):These specifications apply to the design, application, and use of signs or symbols (as included in paragraphs (c) through (e) of this section) that indicate and, insofar as possible, define specific hazards that could harm workers or the public, or both, or to property damage. These specifications are intended to cover all safety signs except those designed for streets, highways, and railroads. These specifications do not apply to plant bulletin boards or to safety posters.  a) On or about 09/07/2024, the employer did not ensure that signs or symbols that defined specific hazards to warn workers in the cotton room of that hazards from the open rotarties in that caution signs were not utilized around the openings where the conveyors were located to prevent employees from falling into the rotaries.
