29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about August 23, 2024, at a jobsite located at 10851 South Christina Ct.,  Oak Creek, WI 53154, the employer did not ensure that employees exposed to potential fall hazards had been properly trained to recognize, minimize, or eliminate the fall hazards associated with this work. This exposed employees to a fall hazard of nine (9) feet up to 20 feet onto grass, building materials, and concrete.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about August 23, 2024,   at a jobsite located at 10851 South Christina Ct., Oak Creek, WI 53154, employees working on the ground performing cleanup and assisting the roofers who were working directly above re-roofing the structure, were not protected from struck by hazards from falling materials and tools by wearing a protective helmet.  Less Estimate Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.100(a), which was contained in OSHA inspection number 1702223, citation number 1, item number 1 and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 16137 Stonewall Dr. Newark, IL.60541.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about August 23, 2024,   at a jobsite located at 10851 South Christina Ct., Oak Creek, WI 53154, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the residential structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the first floor roof of approximately nine (9) feet on the East side of the structure and 20 feet on the South side of the structure.  Less Estimate Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.501(b)(13), which was contained in OSHA inspection number 1702223, citation number 2, item number 1 and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 16137 Stonewall Dr. Newark, IL.60541.  Less Estimate Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.501(b)(13), which was contained in OSHA inspection number 1412367, citation number 1, item number 1 and was affirmed as a final order on January 30, 2020, with respect to a workplace located at 8740-48 Golden Rose 8702-08 Trinity Drive Tinley Park, IL 60478.
