29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  (a) On or about October 18, 2024, at 1257 E. Wild Ginger Way, Oak Creek, WI 53154, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  (a) On or about October 18, 2024, at 1257 E. Wild Ginger Way, Oak Creek, WI 53154,  the employer did not ensure that employees conducting roofing operations exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about October 18, 2024, at 1257 E. Wild Ginger Way, Oak Creek, WI 53154, employees installing a roof on an existing residential home with an approximately 10:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 23 feet 8 inches from the roof eve to the ground below on the back (South) side of the home.  Less Estimate Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1393942, citation number 1, item number 1 and was affirmed as a final order on November 14, 2019, with respect to a workplace located at 4705 Lee Ave., Downers Grove, IL 60515.  Less Estimate Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1412367, citation number 1, item number 1 and was affirmed as a final order on January 30, 2020, with respect to a workplace located at 8740-48 Golden Rose, Tinley Park, IL 60478.  Less Estimate Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1702223, citation number 2, item number and was affirmed as a final order on December 18, 2023, with respect to a workplace located at 16137 Stonewall Dr., Newark, IL 60541.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about October 18, 2024, at 1257 E. Wild Ginger Way, Oak Creek, WI 53154, employees were using a ladder on the front and right of the house to access the roof which did not exceed 3 feet past the landing area, therefore exposing employees to a fall hazard greater than six feet.  Less Estimate Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1702223, citation number 2, item number 2 and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 16137 Stonewall Dr., Newark, IL 60541.
