29 CFR 1926.20(b)(2): The employer did not initiate and maintain frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about September 19, 2024, at a jobsite located at 10565 S. Rosemont Ln., Oak Creek, WI 53154,  a competent person was on site but did not perform frequent and regular inspections of the jobsite to ensure that hazardous conditions were identified and corrected.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about September 19, 2024, at a jobsite located at 10565 S. Rosemont Ln., Oak Creek, WI 53154, the employer did not ensure that employees exposed to potential fall hazards had been properly trained to recognize, minimize, or eliminate the fall hazards associated with this work. This exposed employees to a fall hazard of up to 11.3 feet onto grass, building materials, and concrete.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about September 19, 2024, at a jobsite located at 10565 S. Rosemont Ln., Oak Creek, WI, 53154, employees conducting roofing activities (shingle installation) on a 4:12 pitch roof of the residential structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the roof of the structure of approximately 11.3 feet.  Less Estimate Construction LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.501(b)(13), which was contained in OSHA inspection number 1702223, citation number 2, item number 1 and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 16137 Stonewall Dr. Newark, IL. 60541.  Less Estimate Construction LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.501(b)(13), which was contained in OSHA inspection number 1412367, citation number 1, item number 1 and was affirmed as a final order on January 30, 2020, with respect to a workplace located at 8740-48 Golden Rose, 8702-08 Trinity Drive, Tinley Park, IL 60478.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about September 19, 2024, at a jobsite located at 10565 S. Rosemont Ln., Oak Creek, WI, 53154,  the portable ladder being used by employees to access the roof of the structure at or near the garage door did not extend at least three feet above the upper point of contact with the eave, nor was it secured in place. This exposed employees accessing and egressing the roof, to a fall hazard of approximately  11.3 feet onto grass, building materials, and  concrete.  Less Estimate Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1702223, citation number 2, item number 2 and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 16137 Stonewall Dr., Newark, IL 60541.
