29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a- 110 Pondview Court, Monroeville NJ:  The company worksite Foreman was exposed to struck by hazards when using an electric, portable circular saw without eye or face protection while cutting plywood, OSB, wooden framing components, and other related materials used in the framing and sheathing activities at the worksite. Condition observed on or about 10/24/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - Front, Porch Roof, 110 Pond View Court, Monroeville NJ:  A worker was exposed to fall hazards, in excess of 19 feet 4 inches, when walking and working  from a residential structure's porch roof joists without the use of fall protection. Condition observed on or about 10/24/24.  b - Front, Window Opening, 110 Pond View Court, Monroeville NJ: A worker was exposed to fall hazards, in excess of 11 feet 8 inches, when working from an unprotected window opening without fall protection.  Condition observed on or about 10/24/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a - 110 Pond View Court, Monroeville NJ:  Workers, not utilizing fall protection, were exposed to fall hazards up to and in excess of 19 feet 4 inches and 11 feet 8 inches to surfaces below when performing framing and other related activities while not utilizing fall protection at the worksite.   These workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  Condition noted on or about 10/24/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
