29 CFR 1910.107(l)(4)(i): All areas were not kept free of the accumulation of powder coating dust, particularly such horizontal surfaces as ledges, beams, pipes, booths and floors:  a) On or about January 6, 2025, the employer did not ensure that effective measures were used to keep powder coating material from accumulating on horizontal surfaces outside of the powder booth exposing employees to fire and deflagration hazards. Accumulations of powder coating material were observed on horizontal surfaces as high as approximately 16 feet, and accumulations were measured at depths up to 1/8 inch on horizontal surfaces 4 feet from the ground.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) On or about December 19, 2024, the employer failed to implement a respiratory protection program when employees were required to wear N95s, a tight-fitting filtering facepiece respirator, when cleaning the powder coating booth and filling the powder coating material.  The respiratory protection program shall include, at a minimum, procedures for selecting respirators; medical evaluations; fit testing; procedures for proper use in routine and reasonably foreseeable emergency situations; procedures for cleaning, inspecting, repairing and discarding respirators; employee training regarding respiratory hazards they are exposed to, proper uses and limitations of respirators; and procedures for regularly evaluating the effectiveness of the respirator program.

Employees were exposed to chemicals hazards including but not limited to corrosives and respiratory hazards.
