29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 2 Minnow Ave., Barnegat, NJ: Worker engaged in installing framing material and other related activities were exposed to fall hazards, up to and more than 10 feet to the ground surface below, when walking / working on the 2nd floor of a residential structure without the use of fall protection. Condition noted on or about 01/16/2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a) 2 Minnow Ave. Barnegat, NJ: Worker was not utilizing fall protection and was exposed to fall hazards up to 10 feet to surfaces below when performing framing installation and other related activities while not utilizing fall protection at the worksite. The workers on site had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). Condition noted on or about 01/17/2025. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
