29 CFR  1910.178(a)(5):The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a.) Pennex Aluminum Company LLC; Shop Area: on or about 07/23/2025 and at times prior thereto, the company was using an attachment on the Big Red Hoist Lift Truck (serial #28761) to load aluminum scrap into the furnace. The data plates on the Big Red Hoist Lift Truck (serial #28761) were not updated to reflect the charging machine attachment being used on the powered industrial truck.   ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR  1910.145(f)(3): Tags were not used as a means to prevent accidental injury of illness to employees who are exposed to hazardous or potentially hazardous conditions, equipment, or operations which were out of the ordinary, unexpected, or not readily apparent:   a.) Pennex Aluminum Company LLC; Shop Area: on or about 07/23/2025 and at times prior thereto, the Big Red Hoist Lift Truck (serial #28761)  had deficiencies that include, but is not limited to, two broken side windows, exposed hanging control wires under the right arm rest, and a damaged seat cushion. The Big Red Hoist Lift Truck (serial #28761)was not tagged out of service to prevent employees from operating the powered industrial truck.   b.)  Pennex Aluminum Company LLC; Shop Area: on or about 07/23/2025 and at times prior thereto, the Clark S35L Lift Truck (serial #S232L-1273-10000 KF) had deficiencies that include, but is not limited to, missing the rubber grip/anti-slip texture on the face of the brake pedal. The Clark S35L Lift Truck (serial #S232L-1273-10000 KF) was not tagged out of service to prevent employees from operating the powered industrial truck.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Pennex Aluminum Company LLC; Shop Area: on or about 07/23/2025 and at times prior thereto, employees operate equipment including but not limited to Big Red Hoist Lift Truck (serial #28761) and the Clark S35L Lift Truck (serial #S232L-1273-10000 KF). Certification records were not provided for one employee.  NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED
