29 CFR 1926.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) On the marine vessel Pacific Pride within three nautical miles of the coast of Guam, on or about September 4, 2012, and at times prior there to, personal flotation devices were not worn by the crew while working and walking on the unsheltered decks.      (b) On the marine vessel Pacific Pride within three nautical miles of the coast of Guam, on or about September 4, 2012, and at times prior there to, appropriate closed shoe footwear was not worn while working and walking on the unsheltered decks.  The crew was allowed to wear flip flop footwear.      OR IN THE ALTERNATIVE:    29 CFR 1915.152(a): The employer did not provide and did not ensure that each affected employee used the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective shields, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of this subpart, wherever employees were exposed to work activity hazards that required the use of PPE:    (a) On the marine vessel Pacific Pride within three nautical miles of the coast of Guam, on or about September 4, 2012, and at times prior there to, personal flotation devices were not worn by the crew while working and walking on the unsheltered decks.      (b) On the marine vessel Pacific Pride within three nautical miles of the coast of Guam, on or about September 4, 2012, and at times prior there to, appropriate closed shoe footwear was not worn while working and walking on the unsheltered decks.  The crew was allowed to wear flip flop footwear.
