OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.      A) Railroad siding, tracks 10 and 11 - On November 8, 2012, and at times prior thereto, while testing for odorant and connecting and disconnecting hoses at the dome platform of LPG rail cars, employees were exposed to a fall hazard of approximately 12 feet.  The guard rail system surrounding the dome platforms consisted of guard rails installed approximately 27" above the surface of the dome platform for rail cars manufactured by American Railcar Industries (such as but not limited to cars TEIX 33737, CTCX 780488, and SRIX 33676), and guard rails installed approximately 30" above the surface of the dome platform for rail cars manufactured by TrinityRail Engineering (such as but not limited to cars TILX 304053, TILX 304083, and TILX 302650).   The guard rails did not meet the required height of 42" (+/- 3").  Additionally, no mid rail system was installed.
