29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about 9/12/18 at a roof project located at 901 South Park Avenue, Buffalo, New York; employees working on the ground below active roof operations were not wearing hard hats.  NO ABATEMENT CERTIFICATION REQUIRED  Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1250566, citation number 2, item number 1 and was affirmed as a final order on 9/20/17, with respect to a workplace located at 75 Como Avenue, Buffalo, New York.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:  a) On or about 9/12/18 at a roof project located at 901 South Park Avenue, Buffalo, New York; employees performing roofing activities from a ladder jack scaffold approximately 19 feet high and were not protected from falling by a personal fall arrest system.  NO ABATEMENT CERTIFICATION REQUIRED  Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1250566, citation number 1, item number 1a and was affirmed as a final order on 9/20/17, with respect to a workplace located at 75 Como Avenue, Buffalo, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) On or about 9/12/18 at a roof project located at 901 South Park Avenue, Buffalo, New York; employees were placing shingles on the roof of a two story building. The roof had a 10 in 12 pitch and an eave height of approximately 21 feet. There was no fall protection in use.  NO ABATEMENT CERTIFICATION REQUIRED  Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1250566, citation number 1, item number 2 and was affirmed as a final order on 9/20/17, with respect to a workplace located at 75 Como Avenue, Buffalo, New York.  Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1254400, citation number 1, item number 1 and was affirmed as a final order on 9/19/17, with respect to a workplace located at 36 Woodcliffe Terrace, Cheektowaga, New York.
