29 CFR 1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilivered end:    a) On or about 03/20/19, on the site of a 3-story house at 245 Lexington Ave., Buffalo, NY: Employees were working from the approx. 12 ft. long  aluminum pik of a ladder jack scaffold erected on the west side of the of the house. The pik extended over the south support bracket by approx. 3 ft.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:  a) On or about 03/20/19, on the site of a 3-story house at 245 Lexington Ave., Buffalo, NY: A Ladder Jack Scaffold was erected on the west side of the house. Two employees were on the aluminum pik of that scaffold while installing a fascia. The employees were exposed to a fall of approx. 18 ft. because no fall protection was being utilized.     NO ABATEMENT DOCUMENTATION REQUIRED       Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1346658, citation number 1, item number 2 and was affirmed as a final order on 10/22/2018, with respect to a workplace located at 901 South Park Avenue, Buffalo, NY 14210.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a) On or about 03/20/19, on the site of a 3-story house at 245 Lexington Ave., Buffalo, NY: Three employees engaged in roofing work on the steep roof on the front left side of the house were exposed to a fall of approx. 20 ft. because fall protection was not being utilized. Pitch of the roof was approx. 12 in 12.  NO ABATEMENT DOCUMENTATION REQUIRED    Ackmen Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1346658, citation number 1, item number 3 and was affirmed as a final order on 10/22/2018, with respect to a workplace located at 901 South Park Avenue, Buffalo, NY 14210.
