29 CFR 1904.35(b)(1)(i): You must establish a reasonable procedure for employees to report work-related injuries and illnesses promptly and accurately. A procedure is not reasonable if it would deter or discourage a reasonable employee from accurately reporting a workplace injury or illness. On or about February 3, 2022, at an establishment located at 2121 Brooks Ave, Neenah, WI 54965, Neenah Enterprises Inc. maintained a policy that required all employees suffering an OSHA Recordable Injury or Illness to be subjected to a drug test regardless of whether reasonable suspicion of impairment was present and contributed to the workplace incident.
