29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about January 27, 2023, the employer failed to implement an adequate, effective written respiratory protection program for employees performing fiberglass sanding operations for all provisions in 29 CFR 1910.134 (c)(1)(i)-(ix) with worksite specific procedures. Failure to implement an effective respiratory protection program exposes employees to adverse health effects and exacerbation of underlying health conditions associated with the respiratory system.

29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: On or about January 27, 2023, employees were required to wear respiratory protection while performing fiberglass cutting and grinding operations without having been provided a medical evaluation. Employees were potentially exposed to aggravation of preexisting medical conditions by the employer failing to have them medically evaluated prior to wearing a respirator
