29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- Building 2 - Meridian Walk at Princeton, West Windsor NJ: On or about 11/29/23 a worker and the company worksite Foreman were not protected from falling when walking and working at and near the unprotected edges of a residential structure's second floor while working and walking from floor joists while not using fall protection. As such, this worker and the company worksite Foreman were exposed to fall hazards up to and in excess of 11 feet 7 inches to the ground surface below. b- Building 2 - Meridian Walk at Princeton, West Windsor NJ: On or about 11/29/23 a worker was not protected from falling when walking and working from the top plates of a residential structure's outer wall frames while not using fall protection. As such, this worker was exposed to fall hazards up to and in excess of 8 feet 9 inches to the concrete flooring below.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a - Building 2 - Meridian Walk at Princeton, West Windsor NJ: A worker and the company worksite Foreman working at and near unprotected edges of a residential structure's second floor while working and walking from floor joists and from the structure's outer wall top plates were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii). The company worksite Foreman and their worker were exposed to fall hazards in excess of 8 feet 9 inches while performing the said work above. Condition noted on or about 11/29/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
