29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- Building D - Rising Sun Meadows Development, Bordentown NJ: On or about 06/10/24 a worker was exposed to falls when not using fall protection while walking and working from a residential structure's second floor's unprotected edges AND its outer wall frame's top plates. As such, this worker was exposed to fall hazards in excess of 9 feet 4 inches to the ground surface. New Future Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1713549, citation number 1, item number 1 and was affirmed as a final order on 05/03/24, with respect to a workplace located at Building 2, Meridian Walk at Princeton in West Windsor NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a- Building D - Rising Sun Meadows Development, Bordentown NJ: A worker, exposed to falls when not using fall protection while walking and working from a residential structure's second floor's unprotected edges AND its outer wall frame's top plates, was not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii). This worker was exposed to fall hazards in excess of 9 feet 4 inches while performing the said work above. Condition noted on or about 06/10/24. New Future Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.503(a)(2)), which was contained in OSHA inspection number 1713549, citation number 1, item number 2 and was affirmed as a final order on 05/03/24, with respect to a workplace located at Building 2, Meridian Walk at Princeton in West Windsor NJ.
