29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level:   a - 44, 46, 48, 50 Marion Avenue, Bordentown NJ:  Workers were exposed to fall hazards, in excess of 23 feet 7 inches to the ground surface, when walking and working from  residential units exterior wall top plates while wearing full body harnesses whose connected lanyards were improperly anchored.  These worker's lanyards were anchored to the roof truss by wrapping them around an inner chord/metal gusset plate and connecting them back to their individual lanyard.    Condition observed on or about 07/25/24.  b - 44, 46, 48, 50 Marion Avenue, Bordentown NJ:  Workers were exposed to fall hazards, in excess of 9 feet to the flooring below, when walking and working in and above a residential unit's wooden roof trusses while wearing full body harnesses whose connected lanyards were improperly anchored.  These worker's lanyards were anchored to the roof truss by wrapping them around an inner chord/metal gusset plate and connecting them back to their individual lanyard.   Condition observed on or about 07/25/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - 44, 46, 48 Marion Avenue, Bordentown NJ:  A worker was exposed to fall hazards, in excess of 23 feet 7 inches to the ground surface, when traversing between three residential units using their exterior wall top plates while wearing a full body harness whose attached lanyard was not connected to an anchor. Observed on or about 07/25/24  New Future Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1713549, citation number 1, item number 1 and was affirmed as a final order on 05/03/24, with respect to a workplace located at Building 2, Meridian Walk at Princeton in West Windsor NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   a- 44, 46, 48, 50 Marion Avenue, Bordentown NJ:  Company workers were exposed to fall hazards ranging from approximately 9 feet to in excess of 23 feet 7 inches when improperly using or not using fall protection at the worksite. These conditions existed while these workers were performing sheathing installation, and other related activities when walking and working from residential structure's second floor exterior wall top plates and while in and on pitched roof trusses.  These workers and their worksite Foreman were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  Condition noted on or about 07/25/24.  New Future Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1713549, citation number 1, item number 1 and was affirmed as a final order on 05/03/24, with respect to a workplace located at Building 2, Meridian Walk at Princeton in West Windsor NJ.
